Former employee seeks justice: Everton Sampson’s battle against Canadian Tire Corporation

In a compelling case that has captured the attention of many, Everton Sampson, a dedicated employee of Canadian Tire Corporation (CTC) for 30 years, is seeking justice for what he claims to be wrongful termination under false pretenses. Mr. Sampson, who held a position with an annual compensation package of approximately $105,000, was 52 years old at the time of his termination. According to Mr. Sampson, he was led to believe that he was eligible for the TIRE program, which ultimately influenced his decision to resign. The TIRE program is designed to provide long-serving employees with a smooth transition into retirement. It offers benefits such as phased retirement options, continued health coverage, and financial planning assistance. Employees who qualify for the program can gradually reduce their working hours while maintaining their benefits, allowing them to ease into retirement without a sudden loss of income, or support. Mr. Sampson’s belief that he was eligible for this program was a significant factor in his decision to resign, making the subsequent discovery of his inability a devastating blow.

In his legal claims against CTC, Mr. Sampson is seeking a judicial declaration that his employment was wrongfully, or constructively terminated. He is claiming damages for breach of contract and wrongful dismissal amounting to $215,000, which includes lost salary, overtime, and benefits.

“This isn’t just about me,” Mr. Sampson stated, “It’s about standing up for what’s right and ensuring that no one else has to go through what I did. I dedicated 30 years of my life to this company, and I deserve to be treated with honesty and respect.”

Reflecting on the TIRE program, Mr. Sampson added, “The TIRE program was supposed to be a lifeline for employees like me, offering a smooth transition into retirement. I was misled into believing I was eligible, and that deception has had a profound impact on my life, mental health and career.”

This case highlights the importance of transparency and fairness in employer-employee relationships. Mr. Sampson’s fight for justice is not just about his own situation, but also about standing up against unfair treatment in the workplace.
